These Terms and Conditions of Sale and Delivery apply to items purchased on iMusic.co, iMusic.ca and iMusic.uk

The agreements are entered into in Danish, English, German, Norwegian, or Swedish. The right of cancellation only applies to private consumers who shop at iMusic’s domains. Unless otherwise agreed, commercial and government institutions are not entitled to right of cancellation.

We reserve the right to withdraw from the contract in cases of non-delivery from our suppliers. Should this case occur, we will inform you immediately and refund any payments already made immediately and in full.

Prices

Prices are - depending on the chosen domain - in Euro, Canadian Dollar, British Pound or any other available currency. For delivery to all countries outside the EU, UK and Norway, prices do not include any VAT. The cost of shipping must be added to the price. For deliveries to other countries, the VAT rate is adjusted according to applicable legislation when entering the delivery address in the checkout and the sales price is adjusted accordingly.

For orders outside the EU (except Norway and UK) Local customs taxes and custom clearance fees may apply and be charged from the shipping company upon arrival. Such taxes and fees must be paid by the customer. Local taxes and fees are NOT included in the price shown in our order basket. iMusic has no information on local customs tax amounts to be paid upon arrival. Many countries allow packages of smaller amounts to pass customs clearance without any cost/taxes/fees. Please check the legal regulations in your country for further information.

VAT and orders to the UK

All prices shown on our UK website are including 20% UK VAT. In case your order amount incl. freight and excl. VAT exceeds £135, UK VAT will not be collected from iMusic, as payment of VAT and additional handling charges will be charged upon arrival to the UK directly from the carrier. We will notify you of any changes in the VAT calculation in your order amount when you proceed to step 3 (payment) during checkout. In the order summary on step 3, before you proceed with the payment, you can find specifications about the applicable VAT-rate for your order in advance. You will find this information in your order confirmation email as well.

Pricing Errors

If a price is obviously incorrect and you should reasonably have discovered this, we are not obliged to supply the product in question at the incorrect price.

Payment

We accept payment by VISA, Mastercard, VISA Electron, Klarna, ApplePay and GooglePay. We do not charge card fees and the amount is only deducted when the item is shipped from our warehouse.

In the event that the payment authorization expires before your goods can be shipped from our warehouse (e.g. for pre-orders), it will be necessary to complete a new payment authorization. If applicable, an email with a payment link to renew the payment will be sent when the order is ready in our warehouse.

Regardless of how many items you have ordered, we only charge you for the items that are shipped and not for any backorders before they are shipped.


Reservation of amounts

If you pay with an international payment card, the amount is reserved immediately. The payment is reserved on your card or account until:

1) we withdraw the amount when we ship the goods or

2) until the amount is released as agreed with your card issuer.

When paying with Visa, VisaElectron and Mastercard, the payment is reserved for 30 days, after which the reservation is automatically canceled. You can find out more about the policies for your specific card from your card issuer.


Payment with Klarna

When you shop at iMusic, you have the option to pay via Klarna.

When you choose to pay with Klarna, you will be redirected to Klarna's payment gateway. Klarna's Pay in 3 / Pay in 30 days are unregulated credit agreements. Borrowing more than you can afford or paying late may negatively impact your financial status and ability to obtain credit. 18+, UK residents only. Subject to status. Late fees may apply. Klarna's T&C.

All payments are encrypted and handled by Klarna. By paying with Klarna you accept Klarnas terms and conditions.


Payment with Paypal

When you shop at iMusic, you have the option to pay with Paypal.

When you choose to pay with Paypal, you will be redirected to Paypal's payment gateway. In order to pay the invoice amount via PayPal, you must be registered there or register first. The payment transaction is automatically processed by PayPal when the goods are shipped. By paying with Paypal you accept Paypal’s User Agreement.

Payments via PayPal are subject to a surcharge of 3.3% of the total amount of the order. The surcharge will not be charged until the item is shipped.

Delivery & Shipping Costs

The shipping/handling fee is not included in the product price and is depending on the order weight, package dimensions and country of destination.

All orders are shipped from Denmark. We do offer shipping with Postnord (distributed by your national post), DHL, UPS and GLS. There are both standard and express shipping, parcel shops and home delivery to choose between. Regional differences can restrict the possibilities.

iMusic ships worldwide. Information about shipping methods and shipping rates to other countries can be found by entering the relevant delivery address and country of delivery in checkout, step 2.

Delivery Time

For all items, that are not in stock, the estimated date of shipping from our warehouse is stated in the product description. Shipment of an order will always take place, when the last item of this order has been received in our warehouse.

Delivery from our warehouse to your address varies depending on the chosen shipping method and country of destination. Estimated transit time to your address is stated in checkout step 2 (Delivery) under each shipping method possible.

The estimated transit time for standard delivery is 3-6 working days for orders within the EU, and approx. 10-15 working days (excl. time for custom handling) for orders outside the EU. You may though choose to order express delivery within 1-2 days after shipping.

Local customs & taxes (orders outside the EU & UK)

Local customs, taxes and custom clearance fees may apply and be charged from the shipping company upon arrival. Such taxes and fees must be paid by the customer. Local taxes and fees are NOT included in the price shown in our order basket. iMusic has no information on local customs tax amounts to be paid upon arrival. Many countries allow packages of small amounts to pass customs clearance without any cost/taxes/fees. Please check the legal regulations in your country for further information before ordering.

Right of Withdrawal & Cancellation

You are entitled to cancel an agreement without cause within 14 days. The right of cancellation expires 14 days from the day when you, or another person selected by you (other than the delivery person), takes physical possession of the item.

If you have ordered multiple items in a single order and we are not able to deliver the items simultaneously, the right of cancellation takes effect from the moment when you, or another person selected by you (other than the delivery person), takes physical possession of the final item. If the right of cancellation expires on a holiday, Saturday, Constitution Day (June 5), December 24, or December 31, the expiration will be extended to the following business day.

The right of cancellation becomes null and void if you break the seal on audio and video recordings or on computer software,or if you break the seal on goods that are not suitable for return due to health and hygiene reasons.

How to Invoke your Right of Cancellation

To cancel your order, you will need to notify us of the cancellation. You can do this by sending an email to iMusic’s customer service or by calling us at +45 86 13 73 43 and stating that you are canceling.

You cannot cancel by refusing to receive the item or by refraining from picking it up without giving notice that you are canceling. To meet the cancellation deadline, you must send your message stating that you are canceling your purchase before the cancellation deadline.

Return of Item and Cost of Return

If you have canceled a purchase, you must send the item or deliver it to iMusic, Sindalsvej 36, DK-8240 Risskov, without undue delay and no later than 14 days from the time when you notified us of your intent to cancel.

To meet the deadline, you must return the items within the 14-day deadline. Purchase your return label in our return portal. Please note that returns that do not go through our return portal will not be accepted if they are sent cash on delivery (COD) or to a postal agent. All costs for the return of the order, incl. return freight and for returns from outside the EU also import tax have to be paid by the customer.

You may cancel part of a purchase, provided that the seal on the item(s) has not been broken. The ordinary return policy (as set forth above) applies; however, iMusic will not cover or refund any postage expenses in such cases.

For customers outside the EU we strongly recommend not to return any orders, due to immense costs for import tax to the EU. If you want to cancel your order, please always contact our customer service in advance to see, if we can find an alternative solution for you. In case of orders/items returning from outside the EU, we do unfortunately have to charge received tax invoice or a minimum of 30 EUR for Import tax. Any unpaid charges related to the return will be withdrawn before refunding the order amount.

Testing of Item and Packaging

You are only liable for any loss of the value of the item caused by handling of the item in a manner other than what is necessary for determining the nature and characteristics of the item and the manner in which it works. Normally, you are permitted to inspect the item in the same manner that is possible and permissible in a store, but you may not put it to use. If you have used the item in a manner that is not possible or permissible in a store and we are not able to resell it, or resell it at full price, then we reserve the right to deduct the resulting loss of value from your refund.

In addition, you should ensure that the item is packaged appropriately when returning it. You are liable for the package/items until we receive them. For this reason, save your postal receipt and any applicable tracking code.

Refunds

Withdrawal

When you cancel, we will refund all payments received from you that are equal to the price that you paid for the item(s), as well as applicable shipping expenses paid in connection with the order placement. However, we will not refund shipping and handling expenses or any part thereof if you return only part of a larger order.

For returns from outside the EU any unpaid charges for tax handling related to the return will be charged before the refund will be made.

However, we may retain the refund until we have received the returned items or until you have provided us with documentation that the items have been returned. We will process your return using the same payment method that you used for the original transaction, unless otherwise expressly agreed by you. In any circumstance, the refund will not cause you to incur any surcharges of any kind. We will refund the amount without undue delay and, in any circumstance, no later than 14 days from the date when we receive your cancellation notice.

Complaints

In case of returns due to complaints, iMusic covers return the shipping costs if a return is considered necessary. In those cases we do provide a free return label by email. If you select another delivery method that is more expensive than the least expensive delivery method that we offer, you will not receive a refund for the additional expense. We will refund the amount without undue delay and, in any circumstance, no later than 14 days from the date when we receive your cancellation notice.

Complaints – If Something Is Wrong with the Item / Damage from Wear and Tear

The Danish Purchasing Act applies if you purchase a defective item – e.g., it has a material defect or a manufacturing defect – or if the contents of the delivered item do not match the description of the item at the time of the order. You may file a complaint about defective items within 24 months from the time of delivery by emailing our Customer Service or by calling +45 86 13 73 43. In such case, we kindly ask you to describe the nature of the problem in as much detail as possible, and may ask for pictures and/or videos of the defect.

Always contact our customer service before returning an item/order. Remember to inform of your order number.

To obtain compensation in the event of a complaint, the defect must have been present before you receive the goods. If the damage has been caused by use, iMusic will be able to reject a complaint if the product has had the durability that can reasonably be expected.

In some cases, it may happen that a new item is received from our supplier unsealed or the sealing foil is damaged. In these cases, we do not accept missing or damaged sealing foil as a reason for complaint if the item otherwise is free of defects.

If the complaint is valid, we reserve the right to replace the item in the first instance, unless otherwise agreed. If an exchange cannot be made within a reasonable time, you will get your money back. If the item is to be exchanged, iMusic will send a shipping label paid by us for the return of the defective item. If you still choose to return the item in another way, we will refund your reasonable shipping costs, but only if the complaint is valid. Once the item has been returned, it will be inspected and if the complaint is valid, iMusic will, subject to prior agreement, send a new item or refund the purchase. If the complaint is not considered valid, all shipping costs in the complaint case will be charged to the customer.

For complaints from non-european countries, iMusic does not require the return of defective items, but may instead ask for a proof of destruction of the defective item, in order for us to issue a full refund.

However, a return of a defective item on our costs, must at any time be accepted by our customer service in advance.

Complaints - special terms for kpop

K-pop (Korean pop) is a special product category, where each product typically comes in several different versions, which are distributed randomly by default..

You are always welcome to enter a comment about a preferred version when you submit an order (you can enter a comment on Step 2 during check-out). However, we cannot guarantee availability of the preferred version. We do our best to accommodate all preferences noted in the comments, but we reserve the right to provide a different version if the preferred version is not available.

If you have received a different version than desired, and you want to return the version received, you are still covered by the right of cancellation (see "Right Of Cancellation" above). As a buyer, you are responsible for the return costs.

Official Complaint Options

A complaint about a product or service can be submitted to Nævnenes Hus, the Mediation Team for Consumer Complaints, Toldboden 2, 8800 Viborg via the Complaints portal for Nævnenes Hus. The mediation team will try to resolve the dispute through mediation, and if it does not succeed in finding a solution, you can bring the complaint before the Consumer Complaints Board. It is basically a prerequisite for complaining that the product or service that you want to complain about has cost a minimum of DKK 1,110 and a maximum of DKK 100,000. For complaints about clothes and shoes, the price must in principle be at least DKK 720. The amount limits can be changed. You will have to pay a fee to have the complaint processed.

An official complaint may also be filed via the EU Commission's online dispute resolution portal. This is particularly relevant for consumers residing in an EU country outside Denmark.
