Actions for Judicial Review Brought Before the Ecj: Position of Private Parties

Judicial review of the legality of acts and omissions of the Community Institutions is pursued by means of actions for annulment and failure to act. Natural and legal persons can only bring these actions before the European Court of Justice under strict conditions. This book analyzes the position of natural and legal persons in these actions. The locus standi of private applicants in case law of the European Court of Justice is not entirely consistent, here it is examined from both a theoretical and a practical perspective. Furthermore, this work presents the positions of scholars on the restrictive interpretation of the locus standi conditions adopted by the European Court of Justice. The aim of this work is to demonstrate the difficulties that private applicants meet when they wish to challenge the acts or omissions of the Community Institutions and, moreover, to analyze the justification of the existing restrictions on locus standi. This book shall be useful for both scholars and practitioners interested in the protection of private parties` rights before the European Court of Justice.
